Enclosed are two wills ... the first is complete and is the will of my g-g-g-g-grandfather, Adam Albert and I have enclosed it for an article for others to notice the detail, and value assigned to worldly goods in that period.
The second will is that of Hans Michael Albert, Adam's father. A noteworthy item about it is that one son, William Albert, is named. According to a lawyer friend who specializes in wills and such, the naming serves to eliminate any possibility that the person named would be successful in challenging the will, or the validity.
Following is the Will of Adam Albert as it is recorded in Will Book 8 Frederick County, Virginia beginning on Page 317 (not page 357 as the compilation shows), and the appraisement of Adam Albert's property recorded in the same book on page 333.
I Adam Albert of Frederick County and State of Virginia, taking into
consideration my approaching dissolution do make constitute and ordain
this my Last Will and Testament in manner and form following that is to
say first I will and ordain that all my just debts be paid out of my
Estate by my hereafter named Executors as soon as possible after my
Decease
Secondly I give and bequeath to my beloved wife Flora my negro woman
Pegg during her natural life. I further will and ordain that my said
wife my son George, Adam, Betsy, Polly, Sally, Susannah and Catherine do
each receive an Equal Division out of the moneys arising from the sales
of my estate both real and personal except as above first excepted to my
wife during her natural life, and in case any of my children die without
heir in their mynority or intestate then and in that case my will is
that an Equal division be made of the Estate of such deceased among my
surviving heirs without exception, and if any money or other property
shall hereafter fall to me from the Estate of Henry Shipler decd, or
from his surviving widow my will is that it be wholly converted to the
use of my daughter Betsy and her heirs. I further direct that my
freehold and Leasehold Estate be sold by my Executors as followeth Viz
on a credit of one year for the first payment, and of two years from the
day of sale for the second payment, the whole to be made in two Equal
payments
I also authorize my Executors to negociate and deal with James Chambers
of the State of Kentucky for the redemption of a cer. tract of Land in
that State and now in possession of said Chambers which said tract has
been sold for tax and is offered for redemption and if redeemed to be
disposed of by them as above directed, and Lastly I nominate Constitute
and appoint my beloved son George Aulbert and my trusty friends Daniel
Lynn and John Fry to be Executors of this my Last Will and Testament
hereby revoking and utterly disannulling all other wills grants and
devises by me heretofore made and acknowledging this to be my only and
Last Will.
Signed sealed and declared by the said Adam Aulbert to be his last Will
and Testament in the presence of us who have subscribed our names as
