She has examined "Our Kin and The Cabell's and Their Kin." She thinks there may be some records in Amherst. This message is written on the 2 CONT pages that contain the following information: 1 NOTE 1 NOTE The writer, feeling confident that the original tradition was correct made an exhaustive search for information on that and many similar matters, and finally found, in the old Library of the Maryland Historical Society, an item of three lines 2 CONT in a fragment of Jamestown records covering eleven years-1630 to 1641-which furnished in a positive and indisputable form the proof sought. During the period covered by the fragment, matters became so bad between the Whites and Indians that 2 CONT Opechancanough was induced to agree upon a line being established which neither White nor Indian, excepting truce-bearers, should cross under penalty of being shot on sight. To insure strict obedience to the compact a law was passed at 2 CONT Jamestown imposing a heavy penalty on any of the people crossing the line without a special permit from the Commissioner's Council and the General Court. This accounts for the item alluded to, which was given verbatim et literatim. In the 2 CONT Council record it reads: 1 NOTE 1 NOTE "Dec. 17th, 1641-Thomas Wolfe petitions the Governor to let him see Opechankeno to whom he is allied, and Cleopatra, his mother's sister." 1 NOTE 1 NOTE The record of the General Court was evidently intended to be a verbatim copy though they differ somewhat in phraseology and spelling: 1 NOTE 1 NOTE "Dec. 17th, 1641-Thomas Rolph petitions Gov. to let him go see Opechanko, to whom he is allied, and Cleopatre, his mother's sister." 1 NOTE 1 NOTE It is a well know fact that when Pocahontas died in England in 1616, her husband, John Rolfe, left their infact son, Thomas, to be reared and educated in England by an uncle. Twenty-five years elapsed; the young man had finished his education, 2 CONT and naturally desired to look upon the face of his mother's younger sister. That she was young-17 years or more younger-her name proves. Neither Pocahontas nor her father ever held communication with a white person until the two had a little 2 CONT controversy as to the future fate of Captain John Smith. Pocahontas was then twelve years old, and it is not possible that she or Powhatan could have previously heard the name of the Egyptian queen; and it is not likely that eighter of them 2 CONT had an opportunity to be "coached" upon Egyptian history for a number of years later. Indeed, it is more than probable that Powhatan and his people first heard of the fascinating Cleopatra from John Rolfe, after he had married Pocahontas. 2 CONT What could be more likely than that the young Englishman himself made selection of the name and, with his own lips, pronouced the difficult foreign syllables when the gentle savage infant received her baptismal dip into the purling water of the 2 CONT James River, near where Richmond city now stands? 1 SOUR @S1@ 1 SOUR @S4@ 1 SOUR @S4@ 1 FAMS @F8@ 1 FAMC @F2@ 1 CHAN 2 DATE 1 FEB 1997 0 @I13@ INDI 1 NAME Nicketti /POWHATAN/ 1 TITL Princess 1 SEX F 1 BIRT 2 DATE 1625 1 EDUC 1 SOUR @S2@ 1 NOTE Nicketti, dau. of Cleopatra & Opechancanough, m. a Mr. Hughes, a Scotsman, who was a trader with the Indians. He received the rudiments of education completed only in mathematics. With his brother Charles and John, he explored the upper James Valley. charles went to 2 CONT Georgia and John "went north". 1 NOTE 1 NOTE William Floyd remained in VA and began his working life as a surveyor in the James River Valley up to the foothills of the Blue Ridge and is on the 1735 tithable list. In Amherst County Floyd patented a body of land on which he made a home. 2 CONT (Floyd, Floyd, 11) Sam Burks sold land to Floyd and were neighbors. (Goochland Dd Bk 217,119) In 1745 the areas is Albemarle and William Floyd is paid for one wolf-head which shows the region was still filled with wolves. 1 NOTE 1 NOTE On the 1735 tithable list with William Floyd are William Burk and Joyles Davis in this upper James Valley region. Who are they? They all seem to be young surveyors working together. (Burk is listed in 1743 as surveyor of a road in 2 CONT Goochland.) It is unclear where the road was, possibly in this far western part or maybe the Solomons Creek Road? A William Burk is on a survey team in Prince William backwoods west of Falmouth in 1741. He is surveying with Richard Davis and 2 CONT James Bland for William Champ on Champ's Mill Branch, Occoquan. Chaincarriers are Thomas and Richard Davis, william Burk, surveyor George Byrn. The survey is adjacent William Davis and William Bland. (Joyner, III, 93). Richard Davis, 2 CONT overseer of the road gang, worked in 1743 in newly organized Louisa county on the west side of the South West Mountains on Turkey Sag road which goes to Buck Mountain road leading over Blue Ridge directly to where Peaked Mountain William Burk 2 CONT settled. (Pawlett, Albemarle Roads, 37) Whether these Prince William and Louisa Davis family surveyors are the same as the Amherst Indian trading family is undertain. William Burk is with both groups. Is this Peaked Mountain William before 2 CONT he settled at Peaked Mountain? 1 NOTE 1 NOTE It was in Amherst that William Floyd met the Indian trading Davis family. Amherst was wild and the Davises had traded with the Indians and got much property for Quakers were "much given to trading with Indians." (Ackerly, Our Kin, 144) 1 NOTE 1 NOTE Abadiah Davis was daughter the of Robert Davis and Abadiah. One genealogy says she was a Hughes and another says she was Abadiah Lewis, daughter of Hugh ap Lewis. In support of the latter, Robert Davis had sons Lewis and Hugh. (Cartilidge) 1 NOTE 1 NOTE Abadiah Davis and William Floyd married in Amherst in the autumn of 1747. He was an Amherst county surveyor and militia captain unitl at the end of the Revolution, when he moved to Beargrass, KY with sons Charles and John Floyd. (Floyd, 2 CONT Floyds, 15) William and John Floyd's descendant VA Governor John Floyd Jr. (Democrat 1830-1834) named his daughter Nicketti after the long ago Indian (4GGrandmother). 1 NOTE 1 NOTE William Floyd had land on Pedlar deeded to him by father-in-law Robert Davis. Robert Davis also deed 400 2 CONT acres to John Partree Burk on the south side Pedlar along William Floyd's line witnessed by William Cabell. His parents were listed in Amherst on the 1820 census and in botetourt Co in 1830. Since Hezekiah was born in 1829, either place could have been his birth place. 1 NOTE 1 NOTE In the 50's he went by wagon with his in-laws Henry Miller and Catherine (Montogomery) Miller to IA from Rockbridge Co. They stopped for the winter in Lucas Co where others of the Miller family settled earlier. It was here that his wife 2 CONT Janetta Miller Burks gave birth to a son Joseph Linchfield Burks and a few days later where the mother died; probably the result of childbirth, or perhaps an epidemic of some type as a week later another son Charles Robert died who was 7 years 2 CONT old. It is there at the Goshen Cemetery, Union Twp. that both are buried. 1 NOTE 1 NOTE Later, the Millers and Hezekiah Burks moved on to Ringgold Co. IA. Hezekiah later married Mary Lech Miller wi/of John Addison Miller who died at Vicksburg, MS during the Civil War. John Addison Miller was the brother of Janetta Miller. To 2 CONT this second marriage one child was born, Ida Ruth Burks. 1 NOTE 1 NOTE Little is known of this grandparent; however in 1865 he died after he had developed pneumonia from digging a grave for a neighbor who had died. I have no land records for Hezekiah in VA. Perhaps he was living with his parents when he married 2 CONT at the age of 24, and may have lived with the Miller family. 1 SOUR @S3@ 1 FAMS @F91@ 1 FAMS @F88@ 1 FAMC @F68@ 1 CHAN 2 DATE 11 DEC 1996 0 @I136@ INDI 1 NAME Janetta /MILLER/ 1 SEX F 1 BIRT 2 DATE 8 SEP 1831 2 PLAC Rockbridge Co VA 1 DEAT 2 DATE 6 DEC 1865 2 PLAC Lucas Co IA 1 BURI 2 DATE 9 DEC 1865 2 PLAC Goshen Cem., Union Twp., Luca Co IA 1 EDUC 1 SOUR @S3@ 1 FAMS @F88@ 1 FAMC @F90@ 1 CHAN 2 DATE 11 DEC 1996 0 @I137@ INDI 1 NAME Martha Jane /BURKS/ 1 SEX F 1 BIRT 2 DATE 1833 2 PLAC Botetourt Co VA 1 EDUC 1 SOUR @S3@ 1 FAMS @F89@ 1 FAMC @F68@ 1 CHAN 2 DATE 11 DEC 1996 0 @I138@ INDI 1 NAME William P. /SCRUGGS/ 1 SEX M 1 EDUC 1 SOUR @S3@ 1 FAMS @F89@ 1 CHAN 2 DATE 11 DEC 1996 0 @I139@ INDI 1 NAME Henry /MILLER/ 1 SEX M 1 EDUC 1 SOUR @S3@ 1 FAMS @F90@ 1 CHAN 2 DATE 11 DEC 1996 0 @I140@ INDI 1 NAME Catharine /MONTGOMERY/ 1 SEX F 1 EDUC 1 SOUR @S3@ 1 FAMS @F90@ 1 CHAN 2 DATE 11 DEC 1996 0 @I141@ INDI 1 NAME Mary /LEECH-MILLER/ 1 SEX F 1 EDUC 1 SOUR @S3@ 1 FAMS @F91@ 1 CHAN 2 DATE 11 DEC 1996 0 @I142@ INDI 1 NAME William Henry /BURKS/ 1 SEX M 1 BIRT 2 DATE 3 JUN 1856 2 PLAC Rockbridge Co VA 1 DEAT 2 DATE 27 FEB 1926 2 PLAC St Joseph, Buchanan Co MO 1 EDUC 1 SOUR @S3@ 1 NOTE I know very little about William Henry Burks as he was never mentioned in the family according to my father, and my cousin Mary Ann burks, d/o Reid Burks reports the same. They lived here about 8 years and removed to Fayette Co GA and lived there several years. About 1832 they removed to 2 CONT Tuscaloosa Co AL. He and his wife bought land in Tuscaloosa Co in 1836. About 1841, they removed to MS. He and his wife sold land in Tuscaloosa Co AL in 1841 and it seems that they did not live in AL after that year. In 1848 he started 2 CONT paying taxes in Chickasaw Co MS. He died intestate in 1863. In 1868 the settlement of his estate was started. He recorded for the 1850 census that he was born in TN. (See AL Archives Dept., "Burks Family Records File.") 1 NOTE 1 NOTE •Notes from Gayle Basaldu, Everman, TX Dec 1994: 1 NOTE Fought in the War of 1812. Served as a Private in Captain G.C. Obtained 13 Apr 1995. Information furnished to Clyde Campbell by Marjorie Jackson 8/8/61. 1 NOTE War of 1812-served under Gen. Claiborn in LA, discharged at Baton Rouge. Unknown where he enlisted, or wat state he served from. 1 NOTE 1816-married in Jasper co GA. 1 NOTE 1832/33-moved from Ga to Tuscaloosa AL. 1 NOTE 1841/43-moved from AL to MS. Settled in Chickasaw Co MS. 1 NOTE Born in TN or GA. He told 1850 Census taker he was born TN. 1860 Census gives him born in GA. His widow said he was born Lincoln Co., GA. 1 NOTE His descendants were told the family was originally from VA. There are echoes of NC-vague, nothing definite. TN was NC into 1796. 1 NOTE Older relatives in Columbus, MS say he was an orphan. that when he was a samll boy, his mother tokk him and a small borther to live eith relatives-kind of relatives, where they lived, unknown. do not know how much value to put on that 2 CONT story. These are the same relatives who said he was born in Ireland. 1 NOTE 1 NOTE No clues to name of his father, or mother. He named his first dau Margaret. This is not a Walthall name. He named his oldest son and child Bennett. Not a Walthall name. The next oldest son was named Edward W. which is for father of his 2 CONT wife, Edward Walthall. 1 NOTE 1 NOTE His father may or may not have been a Revolutionary Soldier. He might have been too young to be in Revolution. Born 1770's he could have a son 1796, but too young for Revolutionary war service. Or he may have been a Revoutionary Soldier. If 2 CONT he was not, then William Burks grandfather probably was. 1 NOTE 1 NOTE Mrs. Akin things our William Burks and her James Lyon Burks (m. GA, Revolutionary Soldier) family. Her grandmother and grandfather were both Burks: her grandfather descended from Joseph of Wilkes Co GA and her grandmother from james Lyon Burks 1891-1862. 1 NOTE 1 NOTE You will notice that our William Burks named a son James Lyon Burks and James Lyons Burks names a son William C. James Lyons Burks was an orpha, his mother took him when a samll boy to live in her father's home, is the tale told by his 2 CONT descendants.
