An investigating jury was summoned; an 1 CONC inquest was held. After the autopsy was performed, the body was prepared 1 CONC for burial and was taken by Brown's brothers for interment at his former 1 CONC home in Onslow County. There were circumstances concerning the death 1 CONC which suggested murder. 0 @NI0209@ NOTE 1 CONC Brown had attended a dance at the home of Emma Jackson located on Fifth 1 CONC St between Hanover & Brunswick Sts on Thursday evening. Brown and some 1 CONC buddies arrived while the dance was going on. It was evident that Brown 1 CONC and a companion, J. J. Kennedy*, had been drinking. Brown & friends 1 CONC became disruptive; police were called. A confrontation took place 1 CONC between Brown & Walter Yates (the "floor manager" at the dance). Yates 1 CONC hit Brown in the head with a chair. The two were arrested. Brown fled 1 CONC through the back door. Yates left with the officers but escaped before 1 CONC arriving at the guard house. Yates was arrested Friday morning after 1 CONC Brown's body was discovered. 0 @NI0209@ NOTE 1 CONC Brown, the deceased, is a married man, and leaves a wife and five 1 CONC children in dependent circumstances. For several years he has kept a 1 CONC "cart house" for the accommodation of country people on Market Street. 0 @NI0209@ NOTE 1 CONC (*Per January 19 & 21 articles, the correct name was "J. J. Canady".) 0 @NI0209@ NOTE 1 CONC January 19, 1890 (Sunday) 0 @NI0209@ NOTE 1 CONC Coroner's jury met at the Court House and heard testimony. Inquest was 1 CONC then adjourned until Monday. 0 @NI0209@ NOTE 1 CONC Court case continued against Walter Yates and J. M. Wollard who were 1 CONC charged with assault and battery on deceased a few hours before finding 1 CONC Brown's body. 0 @NI0209@ NOTE 1 CONC Dr. R. D. Jewett had examined Brown's body and described wounds. The 1 CONC doctor did not think the wounds themselves caused death, although they 1 CONC may have stunned deceased so that he might have frozen to death; the 1 CONC night was cold enough to freeze an intoxicated man. 0 @NI0209@ NOTE 1 CONC Walter Way (a dance attendee) testified that Brown and friends had been 1 CONC at the dance two or three hours. J. J. Canady got into a dispute with 1 CONC Yates. Brown then took the quarrel up. J. M. Wollard took Yates' part 1 CONC and struck Brown two or three blows in the face. Yates struck Brown on 1 CONC the back of the head with a chair he had been sitting in. Brown ran out 1 CONC of the house. Fight took place between 12 and 1 o'clock. 0 @NI0209@ NOTE 1 CONC Police Officer E. L. Robinson testified that body was warm when 1 CONC discovered. Robinson said the prow of the engine on train No. 15 must 1 CONC have passed over the head of deceased as it was within a few inches of 1 CONC the rail. 0 @NI0209@ NOTE 1 CONC Dr. T. S. Burbank was directed to proceed immediately to Onslow county 1 CONC and hold an autopsy on Brown's body. Dr. Burbank left for Sneed's (sic) 1 CONC Ferry, Onslow county, where the body of Brown was taken for burial. He 1 CONC was accompanied by a brother of the deceased. 0 @NI0209@ NOTE 1 CONC January 21, 1890 (Tuesday) 0 @NI0209@ NOTE 1 CONC Court continued on Monday afternoon. 0 @NI0209@ NOTE 1 CONC Dr. T. S. Burbank testified that Brown's death was due to blood clots 1 CONC upon the brain and not from cold exposure. Burbank testified that in his 1 CONC opinion Brown's falling on the railroad crosstie could have caused one 1 CONC such wound found on his head but could not have caused all the wounds. 1 CONC The wound on the outer corner of the right eye was made by a blunt 1 CONC instrument; the wound on the inner corner was a lacerated wound. Both 1 CONC wounds could have been made at once by brass-knuckles or a blow of the 1 CONC fist. Gave it as his opinion that the lower edge of the seat of the 1 CONC chair with which Yates struck Brown would have caused the wound on the 1 CONC back of the head of Brown. 0 @NI0209@ NOTE 1 CONC Green Brown, brother of deceased, testified that he accompanied Dr. 1 CONC Burbank. Other testimony was heard describing the same scenario. Court 1 CONC committed Yates of $800 bail on the charge of manslaughter while Wollard 1 CONC was discharged. J. J. Canady was held in a bond of $100 to answer for 1 CONC engaging in an affray. 0 @NI0209@ NOTE 1 CONC January 22, 1890 (Thursday) 0 @NI0209@ NOTE 1 CONC Court reconvened on Wednesday afternoon. Court only heard testimony 1 CONC relating to defendant Woolard. 0 @NI0209@ NOTE 1 CONC Dr. Burbank again testified that his opinion was that Brown's death was 1 CONC caused by wounds on the front and back of the head. 0 @NI0209@ NOTE 1 CONC Testimony of 20 to 12 witnesses was taken. It was a repetition of what 1 CONC they had before stated. Court announced its decision and discharged the 1 CONC prisoner, J. M. About this period of his life, too, he took 1 CONC unto himself a second wife, Mary Twaddle, and lived to see a daughter by 1 CONC this union grow to womanhood and marry. 0 @NI0310@ NOTE 1 CONC HISTORY AND HOMES OF LIBERTY HILL SOUTH CAROLINA by Louise Johnston 0 @NI0310@ NOTE 1 CONC LIBERTY HILL 0 @NI0310@ NOTE 1 CONC The origin of Liberty Hill's name is unknown. Older residents said the 1 CONC first settlers loved liberty and moved to the hills. 0 @NI0310@ NOTE 1 CONC Liberty Hill, one of the oldest settlements between the sandbhils and the 1 CONC piedmont sections of South Carolina, is located on highway 97 also known 1 CONC as the John G. Richards highway. The summit of the hills above Beaver 1 CONC Creek is 660 feet above sea level as measured by railroad engineers. 1 CONC This elevation is ideal for the village to be perched on a narrow 1 CONC plateau, which affords beautiful and extensive views over a vast 1 CONC amphitheater stretching to far away horizons into Kershaw, Fairfield, 1 CONC Chester and Lancaster counties. This small community reeking with rich 1 CONC history claims fame from natives, who have gone out to take prominent 1 CONC places in the world. Among famous sons in later years are the late John 1 CONC G. Richards, Governor of South Carolina 1927-1931. Also James P. 1 CONC Richards, who served with distinction as Fifth District Congressman for 1 CONC 24 years. As chairman of Foreign Affairs Committee he displayed an 1 CONC international attitude combined with practical economy. 0 @NI0310@ NOTE 1 CONC There was a settlement at Liberty Hill as early as 1813 when Peter 1 CONC Garlick's store was a gathering place for farmers of the surrounding 1 CONC country. Early in the 19th century the wealthy planters began to move 1 CONC their residences to Liberty Hill, where they built mansions typical of 1 CONC the period when southern hospitality was in flower. 0 @NI0310@ NOTE 1 CONC In 1858 the Liberty Hill community was one of the wealthiest in South 1 CONC Carolina, for every landowner possessed large estates and many slaves. 1 CONC It was said by persons of wide experience and extensive travels that they 1 CONC had never seen such elegance as was at Liberty Hill. At that time the 1 CONC village was inhabitated by Pattersons, Thompsonsons, Jonses, Georges, 1 CONC Cunninghams, Dixons, Browns, McDows, Perrys, Gilberts and Mathesons. 1 CONC Later other prominent families of Richards and Floyds moved to the 1 CONC village. Probably no comparable area in South Carolina saw more of the 1 CONC glory and tragedy that was the 'OLD South" -- her slaves, her wealth, her 1 CONC gracious living, her brave sons and gifted daughters passed through a 1 CONC tortured past towards a new life. 0 @NI0310@ NOTE 1 CONC The fertile soil, slave labor and the climate had favored the wealthy 1 CONC planters to grow a special long staple cotton, which demanded premium 1 CONC prices bought directly by London buyers. The cotton was shipped to 1 CONC Charleston on river barges from landings along the Catawba and Wteree 1 CONC River and from there to London. 0 @NI0310@ NOTE 1 CONC The sons of the planters went north or to Europe for education. Their 1 CONC sisters attended fashionable "Finishing schools". 0 @NI0310@ NOTE 1 CONC But war, a depleted soil, loss of slaves took their toll after 1865. 1 CONC Even though many were reduced to poverty, Liberty Hill citizens remained 1 CONC solid and continued to produce leaders and real men in the changed South. 0 @NI0310@ NOTE 1 CONC A greater part of General William T. Sherman's army crossed Wateree River 1 CONC at Peay's ferry and camped at Liverty Hill for nine days. The Union 1 CONC soldiers plundered all homes and carried off treasured heirlooms and 1 CONC every thing of value. They burned the beautiful homes of Joseph 1 CONC Patterson, Robert Cunningham and James B. Cureton, the Academy and a 1 CONC tannery owned by John Brown. 0 @NI0310@ NOTE 1 CONC At the close of the War between the States the entire community had been 1 CONC reduced to a state of abject poverty. The freedom of slaves, the 1 CONC destruction of property by Sherman's army and the demoralization of 1 CONC business in general contributed to the cause of reducing this once proud 1 CONC and wealthy people to a condition of helplessness and despair. 0 @NI0310@ NOTE 1 CONC Since Liberty Hill was an agricultural community, it was slow adjusting 1 CONC to the new conditions during the Reconstruction period and many young men 1 CONC left home for more promising fields. 0 @NI0310@ NOTE 1 CONC While present day inhabitants of Liberty Hill do not possess the wealth 1 CONC of their ancestors, they enjoy the use of moddrn conveniences of running 1 CONC water, electricity, radios, television and paved highways. 0 @NI0310@ NOTE 1 CONC Tourists passing theough Liberty Hill often stop to inquire about the 1 CONC history of the colonial residences. The homes of interest in this 1 CONC article were built by Joseph Cunningham, John Brosn, James Stropshire 1 CONC Thompson, and William Dixon. 0 @NI0310@ NOTE 1 CONC Cunninghams Came To County in 1767 0 @NI0310@ NOTE 1 CONC Arthur Cunningham, a Scotch-Irish Presbyterian immigrant with his wife 1 CONC and two children, landed in Charleston, SC December 22, 1767 from the 1 CONC ship, "Earl of Donegal". He and his wife, Jane, were each 30 years old, 1 CONC his daughter, Anne, age 7 years, his son, James, age 4 years. 0 @NI0310@ NOTE 1 CONC He was given a bounty of land, 300 acres, in Craven County -- now Kershaw 1 CONC County -- in the Beaver Creek Section Records in Charleston and Columbia 1 CONC libraries show that while under British rule in 1761, authorities wishing 1 CONC to secure Protestant immigrants, who spoke the English language, were 1 CONC offered a bounty of land in South Carolina. 0 @NI0310@ NOTE 1 CONC It is thought that a brother of Arthur Cunningham came over in the same 1 CONC ship and settled in Edgefield County. 0 @NI0310@ NOTE 1 CONC Dr. Robert B. Johnson's McWillie - Cunningham genealogy states that 1 CONC Arthur Cunningham was a renter or a leasee in Ireland where a landlord 1 CONC had the right to require a renter to assist in gathering his crops 1 CONC regardless of whether it suited the tenant or not. After losing his own 1 CONC crop for having to comply with his landlord's demand, Arthur Cunningham's 1 CONC sence of justice was so outraged that he told his wife, Jane, - "There 1 CONC must be a better country than this. If you are willing we will go to 1 CONC it". So he and his wife decided to come to America. 0 @NI0310@ NOTE 1 CONC Many of the estates along Beaver Creek and at Liberty Hill were parts of 1 CONC the land given to Arthur Cunningham. 0 @NI0310@ NOTE 1 CONC Family traditions and history relate that "Arter" Cunningham was a 1 CONC sturdy, energetic man with peculiar characteristics. Evidence of his 1 CONC strength was his habit of riding his horse at a gallop to Camden (a 1 CONC distance of 20 miles) and back the same day. He kept up this practice 1 CONC until he was past 80 years of age. 0 @NI0310@ NOTE 1 CONC "Arter" measures the characteristics of his sons as "James drinks all; 1 CONC Robert spends all; Joe saves all". 0 @NI0310@ NOTE 1 CONC Arthur Cunningham was born in 1725 and died in 1828. He was more than 80 1 CONC years old when he married the second time. Before his death, in 1850, his fortune 1 CONC was perhaps the largest that has ever been accumulated in the county, 1 CONC approximating the million dollar mark, then very unusual in the United 1 CONC States; and his wealth was all from farming operations. He had a passion 1 CONC for land and had vastf tracts in the northern section of the county, as 1 CONC well as "Betty Neck" and "Stockton" in the lower section, and large 1 CONC interests in Pickens County, AL. He owned about 800 slaves, and it is 1 CONC said, never sold one. He was of irreproachable 1 CONC moral character. On 1 CONC the right of the front entrance is a dining room, which can be opened by 1 CONC large doors into an extra large room originally used as a ball room, now 1 CONC used as a beautiful breakfast room and kitchen The original kitchen or 1 CONC cook room was in the basement of a two story house in the yard. A Dutch 1 CONC oven continues to be a relic in that house. 0 @NI0382@ NOTE 1 CONC The possession of Joseph Cunningham's home passed to William A. 1 CONC Cunningham, his nephew, who added four large rooms and a wide hall to the 1 CONC eastern exposure. The front porch with square columns mounted on solid 1 CONC granite squares was extended to complete the 15 columns. The granite 1 CONC pillows for the foundations, the gte posts and posts for the yard fence 1 CONC were cut on the property by Mr. S. Spurrier, a stone mason. 0 @NI0382@ NOTE 1 CONC Rebecca, a daughter of William A. Cunningham, who married Mr. Lewis 1 CONC Perry, is affectionately known as "Miss Pet". During her frequent visits 1 CONC to Liberty Hill relatives she told interesting incidents which happened 1 CONC when Sherman's soldiers camped at this home. "Miss Pet" and her little 1 CONC brother were frightened when a Yankee soldier set fire to a broom in an 1 CONC upstairs room. They were helped by another soldier to put out the 1 CONC blaze. She related that meat, especially hams, were saved by storing 1 CONC them around the edge of a cistern under the carriage house. The loyal 1 CONC cook, who was forced to prepare food for the Yankee soldiers, adroitly 1 CONC had part of the food under steps for the Cunningham family. 0 @NI0382@ NOTE 1 CONC The ante-bellum mansion passed possession from the Cunninghams to Rev. 1 CONC John G. Cunningham in the early prt of the 18th century, 1 CONC later purchased by Robert Cunningham, his brother, was burned by Yankees 1 CONC or freed Negro slaves. The family barely escaped through windows for all 1 CONC the doors were locked. As Mrs. Robert Cunningham went out with a small 1 CONC baby in her arms the steps which were on fire fell in. 0 @NI0397@ NOTE 1 CONC Since there was no cook after the slaves were freed, the Cunninghams 1 CONC lived in the cook's house and the carriage driver's house. The upper 1 CONC part of the smoke house was floored and used for the boys' room. 0 @NI0397@ NOTE 1 CONC In recent years an after-dinner cup was found whee the large home was 1 CONC burned. Except for its being burned black the cup is in perfect 1 CONC condition. 0 @NI0397@ NOTE 1 CONC The Cunningham family continued to live in the cook's and the carriage 1 CONC driver's houses until October 1925 when Mr. Charles D. Cunningham moved 1 CONC the two houses to the original home site. By joining the houses with a 1 CONC hall and adding two rooms, a comfortable home was built as shown in the 1 CONC picture. 0 @NI0397@ NOTE 1 CONC Before the large twelve room home was burned it was one of the show 1 CONC places of the village. The first and second stories were surrounded by 1 CONC wide porches with columns: Some of the hearths were made of Italian 1 CONC marble. 0 @NI0397@ NOTE 1 CONC At one time most of the property was fenced. The three long bars rest on iron pegs 1 CONC inserted into the granite posts. 0 @NI0397@ NOTE 1 CONC The terraced ten foot wide walk from the gate tothe house has five 1 CONC granite steps about fifteen feet apart. The original grdenia hedge along 1 CONC the walks continue to bloom each spring. The huge gte posts with caps 1 CONC weighing approximately a ton and the granite for the fences and walkways 1 CONC were quarried on the property by Mr. Spurrier, a rock mason, who worked 1 CONC on the State House in Clumbia. 0 @NI0397@ NOTE 1 CONC The large mill rocks across the driveway near the house steps were moved 1 CONC there from an old water mill on Cedar Creek. Dry wells were used in 1 CONC those days for refrigertion. The Cunninghams built theirs on the north 1 CONC exposure of their home. The dry well is an underground room walled with 1 CONC granite over shich a room was built for storage. The underground room 1 CONC was used to keep watermelons, milk and wines, etc. 0 @NI0397@ NOTE 1 CONC The carriage house with its two nine by seven feet doors and a hole cut 1 CONC in the rear wall through which the carriage tongue projected is still 1 CONC standing.
