See also 1910 Missouri Census, 1920 2 CONT Missouri Census and marriage license. 2 CONT 2 CONT Darius Phillips is proven to be the son of Leonard Phillips and Roena 2 CONT Tucker Phillips who were married in August of 1835 in Mason County, 2 CONT Kentucky. Leonard was at the time of his marriage between 60 and 70 2 CONT years of age. Roena was somewhere around 21. The family is not found on 2 CONT the 1850 census together, but the children are shown in other households, 2 CONT probably due to the old age and improvished condition of the father. 2 CONT Darius is shown with Ms. Cooper. On 1860 census, Darius is married and 2 CONT living next door to a widow named Roena Phillips. In checking the tax 2 CONT records of Bracken County, Kentucky, the name of Leonard first appears in 2 CONT 1844 and disappears in 1851. Roena Phillips' name then begins to 2 CONT appear. In court records at Bracken County there is a single notation of 2 CONT funds having been rescinded by the Court for care of one Leonard 2 CONT Phillips, he having died on February 2, 1852. This indicates that the 2 CONT family was probably impovrished and living at the county poor farm. (The 2 CONT fee for caring for Leonard was to have been $25.00 for one year; however, 2 CONT when he died, this amount, less $1.75 for one day's care and burial, was 2 CONT returned to the county.) 2 CONT 2 CONT Further proof that Leonard and Roena were parents of Darius is evident in 2 CONT the fact that Darius named two of his children Leonard and Roena. Record 2 CONT of the birth of twins, Leonard Phillips and William Thomas Phillips, is 2 CONT found at the Genealogical Society Library in Frankfort, Kentucky. The 2 CONT twins were apparently named for the respective fathers of the parents, 2 CONT Teake Ann Curtis' father having been William Thomas Curtis who married 2 CONT Elizabeth Smitson. 2 CONT 2 CONT Darius was involved in a number of lawsuits in Robertson County (a county 2 CONT formed from Mason, Nicholas and Bracken Countys in 1862), one of which 2 CONT involved his mother and two of his sisters and their husbands. In July 2 CONT of 1873, a suit was filed by Solomon and Sarah Jane Phillips McKenzie, 2 CONT Malcolm and Elizabeth Phillips McKenzie, Roena Phillips and Josephine 2 CONT Phillips against Darius Phillips, James Cumber and James E. Brown. 2 CONT (Josephine Phillips was the daughter of Sarah Jane Phillips, as shown in 2 CONT another lawsuit). The suit states that Darius had raised a crop of 2 CONT tobacco on land rented from the plaintiffs and was supposed to pay the 2 CONT rent from the proceeds of the tobacco crop. However, Darius apparently 2 CONT took the crop into Mt. Olivet, the county seat, and sold it to Cumber and 2 CONT Brown and then did not pay the rent. In the December term of Court, the 2 CONT suit was dismissed by plaintiffs, perhaps having been settled out of 2 CONT court. 2 CONT 2 CONT In the same yar of 1873, a lawsuit was filed by one James Kenton, 2 CONT assignee of John Linville, for collection of a $130 promissory note made 2 CONT by Darius in 1870. Kenton is asking for $175 plus costs, etc. Outcome 2 CONT of this case is unknown at this time. 2 CONT 2 CONT Darius brought his large family to Missouri some time in the late 1870s, 2 CONT leaving one daughter who had already married in Kentucky. The family 2 CONT went first to Ellsworth County, Kansas, where another daughter married 2 CONT and then all returned to Missouri about 1882 and settled in Pettis County. 2 CONT 2 CONT Darius was a farmer by occupation and was also known to be a 2 CONT "muleskinner." This may have been his assignment as a private in Company 2 CONT I, 10th Regiment, Kentucky Volunteers in the Civil War. He enlisted in 2 CONT the Union Army on August 10, 1862 and served until his company was 2 CONT mustered out at Maysville, Kentucky on September 17, 1863. At the time 2 CONT of his military service, his personal description was: gray eyes, black 2 CONT hair, light complexion and 5' 11" in height. 2 CONT 2 CONT Darius lost the sight in his left eye as a young man and eventually the 2 CONT right also was blind. There are two stories given for the loss of his 2 CONT eye -- one says that he was night hunting and a tree branch fell, hitting 2 CONT him in the eye. Other family members were under the impression that he 2 CONT lost his eye when struck by the "cracker" on a bull whip. If he were a 2 CONT muleskinner, the latter story would seem quite probable. 2 CONT 2 CONT Darius was said to have a firey temper (a tendency inherited by a number 2 CONT of his descendents). A great-granddaughter, Lettie Shipler, remembered 2 CONT that Darius appeared tall and was almost totally bald and that he wore a 2 CONT black skull cap. Hanna Phillips, age 12, is shown as living with Family No. 2 CONT 636, Peter and Elizabeth Linville. Her occupation is listed as "serving." 2 CONT 2 CONT The 1870 census of Robertson County, Kentucky shows Roena keeping house 2 CONT for Thomas Brierly in Family No. 54. Thomas Brierly is listed as age 2 CONT 85. In a suit filed in 1872, Roena states that Thomas Brierly promised 2 CONT her and her family his property for their care of him during his illness 2 CONT and old age. Thomas Brierly's brother contended that his brother has 2 CONT promised his land to him if he built a house on one corner of the 2 CONT property. The brother had done so and was objecting to the land being 2 CONT given to the Phillipses. The Phillips family won the lawsuit and took 2 CONT title to the land, but it was soon sold off in small parcels, probably to 2 CONT pay debts. 2 CONT 2 CONT The 1800 census of Robertson County, Kentucky shows Roena and Hannah 2 CONT living with Malcolm and Elizabeth McKenzie (Family No. 87). He 2 CONT returned to his home in Missouri when he suffered typhoid fever in 2 CONT quarters and was mustered out of service in January of 1899 after 2 CONT extended care adn being under doctor's orders for several months and 2 CONT unable to return to service. 2 CONT 2 CONT James married first Cathleen Williams. It is believed he left her and 2 CONT his six daughters when Cathleen became ill and soon after her death 2 CONT married Carrie Ray. Carrie was only 21 and had known Jim only 3 weeks 2 CONT when they were married. It is unlikely that Carrie knew about Jim's 2 CONT first family for years because she was a very kind-hearted person and it 2 CONT is believed she would have insisted upon taking care of them. Jim's 2 CONT second family knew very little about their half-sisters, not even their 2 CONT names. 2 CONT 2 CONT James Phillips did not have a reputation for being a kind man, but was 2 CONT respected by his children, who called him Papa. He played with Pat Boone's backup band and appeared on 2 CONT the Arthur Godfrey Show as a regular attraction for several months, both 2 CONT on radio and television. When he was with the Tex Williams band, he 2 CONT played background music for a number of movies, including several of the 2 CONT Walt Disney animated films. During his youth, he played with a band 2 CONT which appeared in Hawaii and during this time he contracted 2 CONT tuberculosis. The disease progressed to the point whree he was near 2 CONT death in the late 1940s. He had a lung and nine ribs removed in an 2 CONT attempt to halt the progress of the disease; however, the other lung was 2 CONT also infected. At that time a new family of drugs, including 2 CONT streptomycin was being experimented with but had not yet been released 2 CONT for use by the general public. He was one of the first people to be 2 CONT given the drug as an experiment on human beings. The drug was successful 2 CONT and he was eventually cured of tuberculosis. However, with only one lung 2 CONT remaining, he would spend the remainder of his life with chest problems. 2 CONT 2 CONT As with many in the show business world, he was afflicted with 2 CONT alcoholism, and as a result, he left the business and returned to his 2 CONT home in Missouri in the early 1970s. In Missouri he was able to spend 2 CONT the rest of his days as a recovered alcoholic. He played his music in 2 CONT the Sedalia area until just a few years before his death. 2 CONT 2 CONT From the Sedalia Democrat: James R. Phillips -- James R. (Dickie) 2 CONT Phillips, 70, of 849 Olsen Drive, died Tuesday, April 23, 1991, at 2 CONT Research Hospital, Kansas City. He was born August 30, 1920 in Sedalia, 2 CONT son of James B. and Carrie Ray Phillips. Mr. Phillips was a musician, 2 CONT and had played guitar and violin for popular entertainers including 2 CONT Arthur Godfrey, Tex Williams, Bob Scobie, Spike Jones and Pat Boone. He 2 CONT also played live music on KDRO radio. He was a member of Our Savior 2 CONT Lutheran Church. Survivors include three sisters, Eva Fackler, Route 2; 2 CONT Chessie Hopkins, 857 Olsen; and Helen Bohon, 901 Olsen. Funeral services 2 CONT will be held at 1:00 p.m. Friday at the Ewing Funeral Home with the Revs. 2 CONT Nothwehr and Hoehe officiating.
