In the Matter of the Estate of John W. Reed, Deceased}

Comes now L. C. Briggs and shows to the Court that John W. Reed, deceased, parted this life at Tulsa in the County of Tulsa and State of Oklahoma on or about the 16th day of November, A.D. 1919.

That the said decedent was at the time of his death a resident of Tulsa in the County of Tulsa and State of Oklahoma.

That said decedent left estate in the County of Tulsa, State of Oklahoma. That due search and inquiry has been made to ascertain if decedent left a will but none has been found, and according to the best information and belief of petitioner, said decedent died intestate.

That the general character and probable value of the estate left by decedent is as follows:

Cash to amount of about  $ 500.00
One popcorn wagon  350.00
Furniture and fixtures  50.00
Personal affects  25.00

That the names, ages and residence of the heirs at law of the decedent so far as known to your petitioner are as follows:

Edward E. Reed, age 21 years, residence McAlester, Okla.

That your petitioner is a friend of said decedent and is advised and believes that he is entitled to administer upon said estate of John W. Reed.

That L. C. Briggs for whom letters of administration are herein prayed is a resident of Tulsa County, State of Oklahoma, with post office address at #410 N. Cincinnati St., Tulsa in said County.

Wherefore petitioner prays that upon hearing had hereon letters of administration issue to said L. C. Briggs.

I Everett E. Reed, being first duly sworn upon his oath states that on the 10th day of May 1919 he was Twenty-one (21) years of age; that he is the youngest childe of John W. Reed, deceased, who died at Tulsa, Okla. On the 16th day of November 1919, at the age of Sixty-eight (68) years, and was buried in Rose Hill Burial Park, Tulsa, Okla. On the 21st of November 1919; That the names of his Brothers and Sisters are as follows: Hollis Burton Reed, age 25 years; Edna May Reed, age 22 years, Hazel Mable Reed, now dead; That the last time he saw Hollis was at Atchison Kansas in the year 1909 and last time he has heard from him being alive wasin year 1910 at Snow, Idaho and he has since written several times to him also the Postmaster there and received nothing from him or the postmaster showing whether he was alive or dead. That the last time he saw his sister, Edna May, was about year 1901 at Sioux Falls, S. Dakota, and in year 1909 he heard directly from her but since that time he has made many efforts to locate her but without success and he does not know the location or address of either his Brother or Sister, or whether either on or both are dead or alive.

ORDER OF SALE OF PERISHABLE PROPERTY

L. C. Briggs, administrator of the estate of John W. Reed, deceased, having on the 12th day of January 1920, filed in this Court his petition in due form, praying for an order authorizing him to sell at public or private sale certain perishable property and other property likely to depreciate in value if not disposed of and which will incur loss and expense by being kept, belonging to said estate, the nature, character and description of which are fully set out in said petition filed in this Court and prayed for the order of sale of said property without notice, and it appearing to the Court that the giving of notice of sale of said property would incur additional cost and expense in caring for said property and cause a further loss, depreciation and expense in caring for said property and that for these reasons it is for the best interest of said estate that the perishable and other personal property described in said petition for sale should be sold forthwith without notice by said Administrator at public or private sale in his discretion, and said property is not necessary for support and sustenance of deceased's family.

Therefore, said Administrator is hereby authorized to sell said perishable and other personal property described in his petition forthwith without notice, at public or private sale in his discretion, for cash, and said L. C. Briggs, is ordered to make return of his proceedings under this order without delay.

APPLICATION FOR CITATION TO SHOW CAUSE.

Comes now L. C. Briggs, as administrator of the estate of John W. Reed, deceased, and represents and shows to the court that this Court has heretofore, by its order duly made and entered of record, authorized and directed said administrator to sell a certain popcorn wagon located at the corner of First Street and Main Street, in the city of Tulsa, Oklahoma, and belonging to the estate of said decedent, and that pursuant to said authority the said administrator has sold said popcorn wagon to W. H. Custer for the sum of fifteen hundred dollars ($1500), five hundred dollars ($500) of which has been paid and the balance at the rate of one hundred dollars ($100) per month beginning the 1st day of May, 1920, and that said administrator has had said popcorn wagon leased to one Jennie Burnside by the week since the 2nd day of February, 1920, but the said administrator has heretofore, more than ten days ago, notified the said Jennie Burnside to deliver possession of said popcorn wagon before the 1st day of May, 1920; and the said administrator sold said wagon to the said Custer to be delivered to him on the 1st day of May, 1920; that the said Jennie Burnside has failed and refused to surrender possession of said popcorn wagon to the said administrator or to the said purchaser thereof; that said Jennie Burnside has no interest, right or title in or to said popcorn wagon, and has no right or authority to withhold the possession thereof, but that by so doing the said Jennie Burnside is in contempt of this Court.

WHEREFORE, the said administrator prays that this court make and enter its order directing and commanding the said Jennie Burnside to appear before this court on a day certain to be fixed by the court, and show cause, if any she has, why she has not delivered possession of said popcorn wagon to the said administrator, and to show cause, if any she has, why she shall not be punished by this Court as for contempt.

CITATION TO SHOW CAUSE

Now on this the 1st day of May, 1920, the same being a regular juridical day of the 1920 term of the above styled court, it appearing to the Court that L C. Briggs, as administrator of the said of the said (sic) John W. Reed, deceased, has filed in this cause a duly verified application for citation to show cause against Jennie Burnside to show cause why she does not surrender up possession of a certain popcorn wagon belonging to the estate of the said John W. Reed, deceased, and to show cause why she shall not be punished as for contempt of this Court in refusing to surrender possession of said popcorn wagon,

NOW, THEREFORE, IT IS HEREBY ORDERED, ADJUDGED AND DECREED by the Court that the said Jennie Burnside be and she is hereby commanded to appear before this Court at nine o'clock A.M. on May 3rd, 1920, and show cause, if any she has, why she does not surrender up to the said administrator possession of said popcorn wagon belonging to the estate of said decedent, and to show cause, if any she has, why she shall not be punished as for contempt of this Court in failing and refusing to surrender possession of said wagon to said adminstrator.

Order and Notice of Final Settlement

Be it remembered, that on this, the 6th day of January, 1921 the same being a day of the regular term of the January, 1921 term of County Court within and for the County and the state of aforesaid, it appearing to the satisfaction of the Court that in each of the above named estates the guardian, administrators and executors, therein have viled their final reports, and that said estates are now ready for final distribution, all parties interested therein are given notice and are hereby directed to appear in the County Court Saturday, January, 29th, 1921 at nine o'clock A.M. to show cause why the said accounts should not be approved and final order of distribution made and said estate closed.
