Will of Robert Irving, dated May 26, 1886


In the name of God, Amen.

I, Robert Irving, Senior, of Jersey City, Hudson County, New Jersey, being of sound disposing mind, and of good memory and understanding, do make, publish, and declare the following as and for my last will and testament, that is to say:

FIRST: I order and direct that all my just debts and funeral expenses be paid and satisfied as soon as conveniently can be done after my decease.

SECOND: I give, devise, and bequeath unto my children John Irving, William Irving, Robert Irving, and George Irving, all my farm land and appurtenances at Wheelertown, Herkimer County, State of New York, to have and to hold the same, to them, their heirs, and assigns forever.

THIRD: I give and bequeath unto my son John, in addition to what is devised to him in the foregoing, devise, and bequest the sum of three hundred dollars; to my son William, in like manner, the sum of three hundred dollars; and, to my son George, in like manner, the sum of five hundred dollars. And, all the rest, residue, and remainder of my personal property and money after the payment of my just debts and funeral expenses and the said bequests to my sons John, William, and George, I give and bequeath unto my son Robert.

FOURTH: I give, devise, and bequeath unto my son Robert all my right, title, and interest in the cemetery lot in the Catholic cemetery at West Side Avenue, Jersey City, aforesaid in Block B, Number 111, Certificate number 400, dated September 19th, 1879.

FIFTH: I nominate, constitute, and appoint James D. Manning, Counselor at Law, of Jersey City, as and for the executor of this my last will and testament. And, I hereby revoke and annul all former and other wills by me made.

In witness whereof, I have hereto set my hand and seal at Jersey City, New Jersey, this twenty-sixth day of May, AD eighteen hundred and eighty six.

Signed, sealed, published, and declared by the above named Robert Irving, Senior, as and for his last will and testament in presence of us, who at his request and in his sight and presence, and in the sight and presence of each other, have hereto subscribed our names as witnesses to said last will and testament this twenty-sixth day of May AD 1886.

Carl Raisch, one of the witnesses to the annexed writing purporting to be the last will and testament of Robert Irving, the testator therein named, deceased, being duly sworn, doth depose and say that he saw the said testator sign and seal the said annexed writing, and heard him publish and declare the same as and for his last will and testament. Tat at the time of the doing thereof, the said testator was of sound disposing mind, memory and understanding as far as this deponent knows and as he verily believes that Henry Roth, the other subscribing witness thereto, was also present at the signing, sealing and publication thereof; and that he and this deponent subscribed their names thereto as witnesses, in the presence of the testator, and of each other, ad at the request of the testator, and that said testator died more than ten days ago.

Henry Roth, one of the witnesses to the annexed writing purporting to be the last will and testament of Robert Irving, the testator therein named, deceased, being duly sworn, doth depose and say that he saw the said testator sign and seal the said annexed writing, and heard him publish and declare the same as and for his last will and testament. That at the time of the doing thereof, the said testator was of sound disposing mind, memory and understanding as far as this deponent knows and as he verily believes that Carl Raisch, the other subscribing witness thereto, was also present at the signing, sealing and publication thereof; and that he and this deponent subscribed their names thereto as witnesses, in the presence of the testator, and of each other, ad at the request of the testator, and that said testator died more than ten days ago.

Bouton, the other appraiser was present at the same time and consented in all things to the doing thereof; and that they appraised all things that came to their view for appraisement.
